What is Consent?
Consent is the agreement or permission granted by an individual for something to occur. In the context of Personnel Checks, it refers to the authorisation given by a Subject for information to be collected on their behalf.
What Cases/Case Activities require consent?
- Driving Licence Endorsements & Entitlements: This consent is necessary for the system to retrieve any Driver and License information from the DVLA. This consent will expire three years from the date it is provided, this is regardless of the length of check being run, whether it is a 3 year or 1 year licence check.
- Update Service consent: This consent is required for the system to retrieve any Update Service information from the DBS. This consent does not expire and will allow the subscription to run indefinitely unless it is revoked.
- DBS consent: This is a one-time consent that enables the system to conduct the DBS check. As this is a one-time consent, it does not have an expiration; it becomes void immediately after use.
How does a Subject give consent?
A Subject gives consent through their Subject Portal. After logging into their account, they will be prompted to provide consent for relevant Case activities as part of the Case portal. The Subject will receive an explanation of what the consent involves and can indicate their agreement by checking a box. This process is known as informed consent.
Revoking Consent
A Subject can revoke their consent at any time by logging into their Subject Portal and selecting the ‘Consents’ tab on the left-hand side. In this section, they will see the consents they have provided, including any expiration dates. To revoke a consent, they simply click the revoke button next to the relevant consent.
Getting Consent after it has been revoked?
A new Case will need to be created, after which the Subject will be prompted to provide consent again through their Subject Portal. Once this is given the Case can run as normal.
